1. Acceptance of Terms

By downloading, installing, or using Nutri-E ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

Age Requirement: You must be 18 years or older to use this app. Supplements can have serious health implications, and this app is designed for adult use only.

2. Description of Service

Nutri-E is a supplement and nutrition tracking application that helps users:

• Track daily supplement intake
• Monitor nutrient levels against Recommended Daily Allowances (RDA)
• Scan supplement labels and food photos using AI
• Set reminders and schedules for supplements
• Analyze health and nutrition data

3. Medical Disclaimer

IMPORTANT: Nutri-E is NOT a medical device and does NOT provide medical advice, diagnosis, or treatment.

• The App is for informational and tracking purposes only
• All health information provided is based on general guidelines and may not be suitable for your individual needs
• RDA calculations are based on demographic data and general health recommendations
• AI-extracted nutrition data may contain errors or inaccuracies
• Always consult with a qualified healthcare professional before starting, stopping, or changing any supplement regimen
• Do not rely solely on this app for health decisions
• If you experience adverse effects from any supplement, discontinue use and seek medical attention immediately

4. User Responsibilities

You agree to:

• Provide accurate personal information (age, gender, health status) for RDA calculations
• Verify all AI-extracted supplement and nutrition data for accuracy
• Use the App responsibly and not for any illegal purposes
• Keep your account credentials secure
• Comply with all applicable laws and regulations
• Not attempt to reverse engineer, decompile, or hack the App

5. AI-Powered Features

Accuracy Disclaimer

The App uses GPT-4 Vision to extract nutrition information from photos. While we strive for accuracy:

• AI-extracted data may contain errors, omissions, or inaccuracies
• You are responsible for verifying all extracted information
• We are not liable for decisions made based on AI-extracted data
• Image quality, lighting, and label clarity affect extraction accuracy

Usage Limits

AI features are subject to usage limits based on your subscription tier:

• Free Tier: 10 AI scans to start + 3 per week (max 10 stored)
• Basic: 10 AI scans per day ($4.99/month)
• Pro: 50 AI scans per day ($11.99/month)
• Premium: 160 AI scans per day ($24.99/month)
• Ultimate: 500 AI scans per day ($39.99/month)

6. Subscriptions and Payments

Auto-Renewable Subscriptions

Paid subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Subscriptions are managed through Apple's App Store.

Free Trial

Some subscription tiers may offer a free trial. You will be charged when the trial ends unless you cancel before the trial period expires.

Cancellation

• Cancel anytime through iOS Settings → Subscriptions
• Cancellation takes effect at the end of the current billing period
• No refunds for partial periods
• Access to premium features continues until the end of the paid period

Pricing Changes

We reserve the right to change subscription prices. You will be notified 30 days before any price increase. Continued use after the price change constitutes acceptance.

7. Data and Privacy

• All supplement and health data is stored locally on your device
• We do not sell or share your personal data with third parties for marketing
• Food and supplement photos sent to OpenAI are subject to their privacy policy

8. Intellectual Property

The App, including all content, features, and functionality, is owned by Nutri-E and protected by international copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or distribute the App
• Reverse engineer or attempt to extract source code
• Remove copyright or trademark notices
• Use the App's name, logo, or branding without permission

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Nutri-E is provided "AS IS" without warranties of any kind
• We are not liable for health issues, injuries, or adverse effects resulting from supplement use
• We are not liable for decisions made based on App data or recommendations
• We are not liable for data loss, device damage, or service interruptions
• Our total liability shall not exceed the amount you paid for the App in the last 12 months

10. Third-Party Services

The App integrates with third-party services:

• OpenAI (GPT-4 Vision): Subject to OpenAI's terms and privacy policy
• NIH DSLD Database: Subject to NIH's terms of use
• Apple In-App Purchases: Subject to Apple's terms

We are not responsible for the availability, accuracy, or content of third-party services.

11. Termination

We reserve the right to:

• Suspend or terminate your access for violations of these Terms
• Discontinue the App or any features at any time
• Modify or update the App without notice

Upon termination, you must delete the App from all devices.

12. Indemnification

You agree to indemnify and hold Nutri-E harmless from any claims, damages, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Health decisions made based on App data
• Your violation of any third-party rights

13. Governing Law

These Terms are governed by the laws of Norway. Disputes will be resolved in the courts of Norway.

For users in California, USA: CCPA consumer rights apply (see Privacy Policy).

For users in the EU/EEA: GDPR rights apply (see Privacy Policy).

14. Changes to Terms

We may update these Terms from time to time. Significant changes will be communicated through the App or via email. Continued use after changes constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
